New Update: Dr. Dao Will Likely Get Enormous Settlement from United Airlines

After being forcibly removed from his seat by aviation security officials when he declined to “volunteer”, 69-year-old Dr. David Dao earned massive sympathy from the international community after a video of the incident emerged.


Although Dr. Dao has yet to file a lawsuit, he has already secured a superstar lawyer and filed a petition to gather and preserve all related evidence to the incident. Dao is expected to build an assault and battery case against United and the city of Chicago, and the way things are going, observers forecast that the defendants are going to need to pay up

Other probable charges such as intentional infliction of emotional distress, defamation, false imprisonment and breach of contract may be filed by Dao’s team

According to Aviation law expert Arthur Wolk “My view here is Dr. Dao has a very good case against United Airlines. If I were United Airlines, I’d be all over him to try to get him to accept a reasonable compensation and to go away.”

Goodnow said “Dr. Dao will likely get millions here. The only question is how many zeros will follow the first number. This is going to be a slam dunk, a no-brainer, an easy win. It’s documented on multiple cell phones. There’s no question.”

“That’s just a big fancy way of saying that the officers involved, and/or United Airlines, intentionally engaged in outrageous conduct that could be expected to have an emotional impact on Dr. Dao I think most people would consider this conduct outrageous and I think there’s little question Dao has suffered emotionally.”

Aside the damages Dao can collect involving medical bills, lost wages and general damages, he is also anticipated to seek a substantial amount from “emotional distress” and “pain and suffering.”

“The real money is going to come in the area of emotional distress damages — the pain and suffering. We call those general damages,” addede Goodnow. “That’s where you can juice this up from a monetary perspective.”

Due to the high-profile nature of the case, with an overwhelming public support on Dao’s side, Goodnow believes United is highly expected to go for a settlement and that Dao’s case will not make it to court at all. This would mean a significantly larger payout for Dao, according to him

“What you will see here is a settlement value that will blow away anything Dr. Dao will ever recover in court,” he stated.

Goodnow also explained that the amount of bad PR that the company has received from controversy in just a matter of days has already massively affected the business.

“Look at the attention this case has received in just a few days,” Goodnow said. “Imagine what would happen if you have a public trial and every reporter is covering it. Every day will be another paper cut for United.

David Dao,takes legal action to demand United Airlines Preserve and Protect Evidence

David Dao has filed legal action against United Airlines demanding they preserve evidence that happened aboard their flight, where he was dragged and beaten.

The video of a Vietnamese born Kentucky based doctor being beaten dragged off a united Airlines flight went viral yesterday sparked outrage from a widespread audience internationally.

The video was taken by another passenger who witnessed the incident.

The victim Dr David Dao 69, was boarding a flight from Chicago to Louisville, Kentucky to return home in time for patient visits scheduled for Monday.



Though United first claimed it removed Dao because the flight was overbooked, the airline now claims that space had to be made for four employees to work a shift the next day in Louisville.

None of the four passengers who were asked to leave got up from their seats, including Dao and his wife, and the airline called the police, who proceeded to beat Dao until he was bloody, dragging him through the plane.

David Dao filed an emergency "bill of discovery" against the carrier in Illinois State Court demanding that evidence documenting Sunday's "re-accommodation" aboard a Kentucky-bound plane be "preserved and protected."

That includes all surveillance videos, cockpit voice recordings, passenger and crew lists, incident reports and other items.

Dao "currently has no access to them and believes that serious prejudice" will befall his case if the items are not safeguarded, the court papers state.

However United Spokes person Megan McCarthy said that all passengers aboard that flight will receive compensation equal to the cost of their plane tickets.

The passengers can take their compensation in cash, travel credits or miles

United honcho Oscar Munoz apologized in a public statement Monday — saying they had to "re-accommodate" Dao.
